Kroger and Albertsons' plan for the largest U.S. supermarket merger in history crumbled Wednesday, with Albertsons pulling out of the $24.6 billion deal and the two companies accusing each other of not doing enough to push their proposed alliance through. Albertsons said it had filed a lawsuit against Kroger, seeking a $600 million termination fee as well as billions of dollars in legal fees and lost shareholder value. Kroger said the claims were “baseless” and that Albertsons was not entitled to the fee. “After reviewing options, the company determined it is no longer in its best interests to pursue the merger,” Kroger said in a statement Wednesday. The bitter breakup came the day after two judges halted the proposed merger in separate court cases. U.S. District Court Judge Adrienne Nelson in Oregon issued a preliminary injunction Tuesday blocking the merger until an in-house judge at the Federal Trade Commission could consider the matter. An hour later, Superior Court Judge Marshall Ferguson in Seattle issued a permanent injunction barring the merger . Ferguson ruled that combining Albertsons and Kroger would lessen competition and violate consumer-protection laws. The companies could have appealed the rulings or proceeded to the in-house FTC hearings. Albertsons' decision to pull out of deal instead surprised some industry experts. “I’m in a state of professional and commercial shock that they would take this scorched earth approach,” said Burt Flickinger, a longtime analyst and owner of retail consulting firm Strategic Resource Group. “The logical thing would have been for Albertsons to let the decision sink in for a day and then meet and see what could be done. But the lawsuit seems to make that a moot issue.” Albertsons is unlikely to find another merger partner because it has significant debt and underperforming stores in most of its markets., Flickinger said. Consumers will feel the most immediate impact of the deal's demise, he said, since Albertsons charges 12% to 14% more than Kroger and other grocery rivals. “They had so much debt they had to pay it off it's reflected in their pricing and promotional structure,” Flickinger said. Albertsons CEO Vivek Sankaran testified during the federal hearing in September that his company might consider “structural options” like laying off employees, closing stores and exiting certain markets if the merger with Kroger didn’t go through. “I would have to consider that,” he said. “It’s a dramatically different picture with the merger than without it.” But in a statement Wednesday, Sankaran said Albertsons would “start this next chapter in strong financial condition with a track record of positive business performance." In the company's most recent quarter, Albertsons' revenue rose 1% to $18.5 billion and it reported $7.9 billion in debt. Kroger said it would also move forward in a strong financial position, with revenue down slightly to $33.6 billion in its most recent quarter. The company announced a $7.5 billion share buyback program Wednesday after a two-year pause. Kroger and Albertsons first proposed the merger in 2022 . They argued that combining would help them better compete with big retailers like Walmart, Costco and Amazon, which are gaining an increasing share of U.S. grocery sales. Together, Kroger and Albertsons would control around 13% of the U.S. grocery market. Walmart controls around 22%. Under the merger agreement, Kroger and Albertsons — who compete in 22 states — agreed to sell 579 stores in places where their locations overlap to C&S Wholesale Grocers , a New Hampshire-based supplier to independent supermarkets that also owns the Grand Union and Piggly Wiggly store brands. But the Federal Trade Commission and two states — Washington and Colorado — sued to block the merger earlier this year, saying it would raise prices and lower workers' wages by eliminating competition. It also said the divestiture plan was inadequate and that C&S was ill-equipped to take on so many stores. On Wednesday, Albertsons said that Kroger failed to exercise “best efforts” and to take “any and all actions” to secure regulatory approval of the companies’ agreed merger transaction. Albertsons said Kroger refused to divest the assets necessary for antitrust approval, ignored regulators' feedback and rejected divestiture buyers that would have been stronger than C&S. “Kroger’s self-serving conduct, taken at the expense of Albertsons and the agreed transaction, has harmed Albertsons’ shareholders, associates and consumers,” said Tom Moriarty, Albertsons’ general counsel, in a statement. Kroger said that it disagrees with Albertsons “in the strongest possible terms.” It said early Wednesday that Albertsons was responsible for “repeated intentional material breaches and interference throughout the merger process.” Kroger , based in Cincinnati, Ohio, operates 2,800 stores in 35 states, including brands like Ralphs, Smith’s and Harris Teeter. Albertsons , based in Boise, Idaho, operates 2,273 stores in 34 states, including brands like Safeway, Jewel Osco and Shaw’s. Together, the companies employ around 710,000 people. Kroger sued the FTC in August in federal court in Ohio, claiming that the federal agency’s in-house administrative hearings were unlawful because the FTC was also able to challenge the merger in federal court in Oregon. In paperwork filed Wednesday, the FTC said it expected to update the court on its next steps in that case by Dec. 17. In Colorado, which also sued to block the merger, Attorney General Phil Weiser said Tuesday that he still was awaiting a decision from a state judge. In that case, Colorado also was challenging an allegedly illegal no-poach agreement Kroger and Albertsons made during a 2022 strike. Shares of Albertsons fell 1.5% Wednesday, while Kroger's stock was up 1%.Last week, UnitedHealthcare CEO Brian Thompson was shot to death on a New York City sidewalk in what was clearly a thoroughly planned-out attack. Over the next few days, as authorities hunted for the killer, online progressives did not try hard to hide their delight that a millionaire health insurance executive like Thompson was killed. Social media was flooded with posts and videos—with different ranges of subtlety—suggesting that Thompson, at the very least, did not deserve to be mourned because of all the health care his company has denied to poor and working people. Progressives framed the shooting as an act of self-defense on behalf of the working class. Before the alleged killer was caught Monday, they promised not to snitch if they saw the shooter themselves and fantasized about a working-class jury nullifying all charges, leading to other CEOs getting gunned down with impunity if they oversaw price increases. The narrative that these online progressives clearly subscribe to and perpetuate is one where, in the United States, healthcare is a totally unfettered, unregulated industry; where—because of a total lack of government involvement—wealthy CEOs charge whatever prices they want and then refuse to provide customers what they already paid for without facing any bad consequences. The characterization of healthcare and health insurance companies charging absurdly high prices while treating their customers terribly without the risk of losing them is spot on. But the idea that what caused this was a lack of government involvement in the healthcare system is completely delusional. And this delusion conveniently removes all the responsibility progressives bear for the nightmare that is the US healthcare system. Today, healthcare is one of the most heavily government-regulated industries in the economy—right up there with the finance and energy sectors. Government agencies are involved in all parts of the process, from the research and production of drugs, the training and licensing of medical professionals, and the building of hospitals to the availability of health insurance, the makeup of insurance plans, and the complicated payment processes. And that is nothing new. The US government has been intervening heavily in the healthcare industry for over a century. And no group has done more to bring this about than the progressives. It really began, after all, during the Progressive Era, when the American Medical Association maneuvered its way into setting the official accreditation standards for the nation’s “unregulated” medical schools. The AMA wrote standards that excluded the medical approaches of their competitors, which forced half of the nation’s medical schools to close. The new shortage of trained doctors drove up the price of medical services—to the delight of the AMA and other government-recognized doctor’s groups—setting the familiar healthcare affordability crisis in motion. Around the same time, progressives successfully pushed for strict restrictions on the production of drugs and, shortly afterward, to grant drug producers monopoly privileges. After WWII, as healthcare grew more expensive, the government used the tax code to warp how Americans paid for healthcare. Under President Truman, the IRS made employer-provided health insurance tax deductible while continuing to tax other means of payment. It didn’t take long for employer plans to become the dominant arrangement and for health insurance to morph away from actual insurance into a general third-party payment system. These government interventions restricting the supply of medical care and privileging insurance over other payment methods created a real affordability problem for many Americans. But the crisis didn’t really start until the 1960s when Congress passed two of the progressive’s favorite government programs—Medicare and Medicaid. Initially, industry groups like the AMA opposed Medicare and Medicaid because they believed the government subsidies would deteriorate the quality of care. They were right about that, but what they clearly didn’t anticipate was how rich the programs would make them. Anyone who’s taken even a single introductory economics class could tell you that prices will rise if supply decreases or demand increases. The government was already keeping the supply of medical services artificially low—leading to artificially high prices. Medicare and Medicaid left those shortages in place and poured a ton of tax dollars into the healthcare sector—significantly increasing demand. The result was an easily predictable explosion in the cost of healthcare. Fewer and fewer people could afford healthcare at these rising prices, meaning more people required government assistance, which meant more demand, causing prices to grow faster and faster. Meanwhile, private health “insurance” providers were also benefiting from the mounting crisis. In a free market, insurance serves as a means to trade risk. Insurance works well for accidents and calamities that are hard to predict individually but relatively easy to predict in bulk, like car accidents, house fires, and unexpected family deaths. Health insurance providers were already being subsidized by all the taxes on competing means of payment, which allowed their plans to grow beyond the typical bounds of insurance and begin to cover easily-predictable occurrences like annual physicals. And, as the price of all of these services continued to shoot up, the costs of these routine procedures were becoming high enough to resemble the costs of emergencies—making consumers even more reliant on insurance. With progressives cheering on, the political class used government intervention to create a healthcare system that behaves as if its sole purpose is to move as much money as possible into the pockets of healthcare providers, drug companies, hospitals, health-related federal agencies, and insurance providers. But the party could not last forever. As the price of healthcare rose, the price of health insurance rose, too. Eventually, when insurance premiums grew too high, fewer employers or individual buyers were willing to buy insurance, and the flow of money into the healthcare system started to falter. The data suggests that that tipping point was reached in the early 2000s. For the first time since the cycle began back in the 1960s, the number of people with health insurance began to fall each year. Healthcare providers—who had seemingly assumed that the flow of money would never stop increasing—began to panic. Then came Barack Obama. Obama’s seminal legislative accomplishment—the Affordable Care Act, or Obamacare—can best be understood as a ploy by healthcare providers and the government to keep the party going. Obamacare required all fifty million uninsured Americans to obtain insurance, and it greatly expanded what these “insurance” companies covered. Demand for healthcare shot back up, and the vicious cycle started back up again—which is why the bill enjoyed so much support from big corporations all across the healthcare industry. Before it was passed, economists were practically screaming that the Affordable Care Act would make care less affordable by raising premiums and healthcare prices while making shortages worse. Progressives dismissed such concerns as Reagan-era “free market fundamentalist” propaganda. But that is exactly what happened . Now, the affordability crisis is worse than ever as prices reach historic levels. And, because Obamacare brought American healthcare much closer to a single-payer system, the demand for healthcare far exceeds the supply of healthcare—leading to deadly shortages. There are literally not enough resources or available medical professionals to treat everyone who can pay for care. Also, the tax code and warped “insurance” market protect these providers from competition—making it almost impossible for people to switch to a different provider after their claims are unfairly denied. If it were simply greed, denying customers who already paid would be a feature in all industries. But it’s not. It requires the kind of policy protections progressives helped implement. And on top of all that, despite paying all this money, Americans are quickly becoming one of the sickest populations on Earth. This is one of the most pressing problems facing the country. A problem that requires immediate, radical change to solve. But it also requires an accurate and precise diagnosis—something that, this week, progressives demonstrated they are incapable of making. The 54-year-old TV presenter revealed in 2021 that she had been diagnosed with breast cancer and later underwent a mastectomy during which her breast plus two lymph glands were removed before reconstruction took place. Bradbury has since stopped drinking alcohol and has changed the priorities in her life, but revealed she has received some pushback on social media from sharing her approach. She told The Times Weekend magazine: “I wasn’t close to death, but death looked me in the eyes. So I am more focused on my health than I ever have been. “I don’t drink, I eat a healthy diet and exercise every day. “When I came home from my mastectomy, I promised I would spend time outside every day, and that is my mantra, however poor it might be in this shitty winter.” Bradbury, who has since been given the all-clear, said a doctor recently helped her reframe how she utilises her energy. She recalled: “He said, ‘This drive that you have – you’re running on a credit card. You can push through all sorts of things. But is that the best thing for you?’. “I realised you don’t have to win every race. You don’t have to overcome everything. I don’t want to max out the credit card.” The presenter previously discussed her experience in an ITV documentary, Julia Bradbury: Breast Cancer And Me, which followed her as she came to terms with her diagnosis and prepared to undergo her single mastectomy. Now, the top-seeded Ducks (13-0) and eighth-seeded Buckeyes (11-2) are gearing up for a rematch more than 10 weeks later in a College Football Playoff quarterfinal game at the Rose Bowl on New Year’s Day. Of course, both teams have had ample time for evolution since that 32-31 Oregon win on Oct. 12 in Eugene. But they also have that game and players’ familiarity with each other, not to mention common opponents in the Big Ten. “Sometimes when you’re playing against a team maybe from another conference in the playoffs, there’s a little bit of an unknown, how can you expect this guy to play?” Buckeyes coach Ryan Day said Monday. “What am I really looking at when I look at the teams they’re playing? “This team’s not that way because we played them already and they played in the conference. So there’s again a reference point as we move into this one. So our guys know what they’re up against, but they also know that they’ve evolved and we’ve evolved, and so two very different teams heading into this game. WASHINGTON -- American Airlines briefly grounded flights nationwide Tuesday due to a technical issu e just as the Christmas travel season kicks into overdrive and winter weather is threatening more potential problems for those planning to fly or drive. American flights were cleared to fly by federal regulators about one hour after a national ground stop order was issued by the Federal Aviation Administration. There were 1,447 delays for flights entering or leaving the U.S. early in the day, with 28 cancellations. Snow was falling early in New York and Dallas-Fort Worth International, which is American Airlines' main hub, was getting hit with rain. Dallas-Fort Worth had the most delays, followed by Charlotte, North Carolina, Washington, New York, Chicago and Miami Because the holiday travel period lasts weeks, airports and airlines typically have smaller peak days than they do during the rush around Thanksgiving, but the grind of one hectic day followed by another takes a toll on flight crews. And any hiccups — a winter storm or a computer outage — can snowball into massive disruptions. That is how Southwest Airlines stranded 2 million travelers in December 2022, and Delta Air Lines suffered a smaller but significant meltdown after a worldwide technology outage in July caused by a faulty software update from cybersecurity company CrowdStrike. Many flights during the holidays are sold out, which makes cancellations even more disruptive than during slower periods. That is especially true for smaller budget airlines that have fewer flights and fewer options for rebooking passengers. Only the largest airlines, including American, Delta and United, have “interline agreements” that let them put stranded customers on another carrier’s flights. This will be the first holiday season since a Transportation Department rule took effect that requires airlines to give customers an automatic cash refund for a canceled or significantly delayed flight. Most air travelers were already eligible for refunds, but they often had to request them. Passengers still can ask to get rebooked, which is often a better option than a refund during peak travel periods. That’s because finding a last-minute flight on another airline yourself tends to be very expensive. Just before 7 a.m. Eastern time, the Federal Aviation Administration ordered all American Airlines flights grounded in the U.S. at the airline’s request. American had reported a technical issue affecting its entire system with millions traveling for the holiday. American said in an email that the problem Tuesday morning was caused by a vendor technology issue that “impacted systems needed to release flights.” The groundings couldn’t come at a worse time for the millions of travelers expected to fly over the next 10 days. The Transportation Security Administration expects to screen 40 million passengers over the holidays and through January 2. Airlines expect to have their busiest days on Friday and Sunday, and on Dec. 26, Dec. 27 and Dec. 29. Many flights during the holidays are sold out, which makes cancellations more disruptive than during slower periods. Even with just a brief outage, the cancellations have a cascading effect that can take days to clear up. About 90% of Americans traveling far from home over the holidays will be in cars, according to AAA. “Airline travel is just really high right now, but most people do drive to their destinations, and that is true for every holiday,” AAA spokesperson Aixa Diaz said. Gasoline prices are similar to last year. The nationwide average Thursday was $3.04 a gallon, down from $3.13 a year ago, according to AAA. Charging an electric vehicle averages just under 35 cents per per kilowatt hour, but varies by state. Transportation-data firm INRIX says travel times on the nation’s highways could be up to 30% longer than normal over the holidays, with Sunday expected to see the heaviest traffic. (AP) — Even though their long-shot hopes of winning the NFC North have vanished, the playoff-bound Green Bay Packers believe they can make a legitimate run at their first Super Bowl appearance since their 2010 championship season. A rapidly improving defense gives them ample reason for confidence. The Packers (11-4) followed up a seven-sack performance in a 30-13 victory at Seattle by producing the first shutout of the NFL season, a 34-0 playoff-clinching blowout of the New Orleans Saints on Monday night. Green Bay delivered its first shutout since a 17-0 triumph over Seattle in 2021 and its most lopsided victory since a 55-14 rout of the Chicago Bears in 2014. “We’ve noticed all along that the defense is a lot different this year, and they’ve been making some big-time plays all along,” quarterback Jordan Love said. “But any time you can hold anybody to zero points in the National Football League is pretty awesome.” The Packers were seeking to produce a championship-caliber defense to go along with their dynamic offense when they fired Joe Barry as coordinator in the offseason and brought in former Boston College coach Jeff Hafley to replace him. The Packers haven’t forced this many turnovers since 2011, when they had 38 takeaways. That’s not the only area in which the defense has made strides. Green Bay is allowing just 19.1 points per game to rank sixth in the league in scoring defense. The Packers haven’t finished a season among the top six teams in scoring defense since their 2010 title run, when they yielded just 15 points per game to rank second. Sebastian Zapeta, 33, who federal immigration officials said is a Guatemalan citizen who entered the U.S. illegally, made his first court appearance and was arraigned in Brooklyn criminal court. He appeared briefly before a judge and wore a white jumpsuit over a weathered black hooded sweatshirt. He did not speak. He will remain jailed ahead of his next court date on Friday. The apparently random attack occurred Sunday morning on a stationary F train at the Coney Island station in Brooklyn. Police said Tuesday that identification of the victim was still “pending at this time.” Authorities say Zapeta approached the woman, who was sitting motionless in the train car and may have been sleeping, and used a lighter to set her clothing on fire. Zapeta then used his shirt to fan the flames, leading to her becoming engulfed in the fire, Assistant District Attorney Ari Rottenberg said on Tuesday. Zapeta then sat at a bench on the subway platform and watched, according to police. Rottenberg added that under interrogation Zapeta said he didn’t know what happened, noting that he consumes alcohol. But he alleged that Zapeta identified himself to interrogators in images related to the attack. Video posted to social media appeared to show the woman standing inside the train ablaze as some people look on from the platform, and at least one officer walks by. NYPD Chief of Transit Joseph Gulotta said Sunday that several officers had responded to the fire and one stayed to keep the crime scene “the way it’s supposed to be" while the others went to get fire extinguishers and transit workers. They were eventually able to douse the fire, but “unfortunately, it was too late,” Police Commissioner Jessica Tisch said — the woman was pronounced dead at the scene. Simeon Boikov has been variously described as a misinformation spreader, serial pest and Russian pawn But he may prove a “useful idiot” for the Australian government in securing the freedom of captured Melbourne man Oscar Jenkins. Mr Boikov has been holed up in the Russian consulate in Sydney’s eastern suburbs since December 2022, after being charged with assaulting an elderly man at a pro-Ukraine protest in Sydney’s CBD. While the self-styled “Aussie Cossack” is seeking asylum with the Russians of his own accord and is not a prisoner of the Australian judicial system, opposition foreign affairs spokesman Simon Birmingham said he could be used in an exchange to secure Mr Jenkins’ release. “If he potentially proves himself to be, shall I say, a useful idiot in terms of a possibility for a Christmas swap, well that is something for the government to consider as it looks at ways to potentially bring an Australian free and break him from Russian custody,” Senator Birmingham told ABC Radio on Tuesday. Mr Boikov volunteered himself to be exchanged with Mr Jenkins in a video posted on social media platform Telegram. “I’m sure the Russians will be happy to accept,” Mr Boikov said. “We should bring him home, he shouldn’t have been in Ukraine. “Let’s do a deal.” In a video posted to Russian social media on Sunday, Mr Jenkins is repeatedly slapped and interrogated by a Russian-speaking man assumed to be his captor. Standing in a forest and dressed in army fatigues, Mr Jenkins tells the man he wanted to help Ukraine. The footage was disturbing, Senator Birmingham said. “Obviously, all Australians would want to see and have confidence that this Australian citizen is going to be treated humanely, fairly, in accordance with the type of rules that should apply to prisoners of war,” he said. Parading prisoners of war on social media is a breach of the Geneva Convention relative to the Treatment of Prisoners of War , which dictates that they must at all times be protected against insults and public curiosity. The unfolding drama related to the TikTok ban has taken a new turn . President Donald Trump has asked the Supreme Court to delay a ruling and postpone a decision about whether to allow TikTok to remain on app stores or if it must be sold early next year. The saga has been developing now for several months. Here’s a quick rundown of where it all stands, along with a few thoughts about how this might all end. How the TikTok ban discussion started I first wrote about a potential TikTok ban way back in 2022 when Congress floated the idea of banning the app on government-owned devices. That law actually went into effect in 2023 , but then in April of this year, the House approved a bill that would ban TikTok entirely. ByteDance, which owns TikTok, would have until January 19 to sell the app. App stores would face hefty fines if they let users download the app. The Senate approved that measure, and then President Biden signed the bill that included a provision to extend the ruling. Just recently, an appeals court confirmed the measure once again, saying that the Chinese company should start looking for a new buyer and even suggested that users should start looking for alternatives. How the TikTok ban saga might finally end I’m calling this a saga because the TikTok ban is really about free speech versus foreign interference, especially during election seasons. There are two distinct sides, and it’s looking like the Supreme Court will determine what happens next. On the one hand, users should be able to decide which apps they use. A free speech advocacy group has challenged the Supreme Court to consider revoking the ban . They argue that the federal government should not be in a position to make apps illegal, saying that is what a dictatorship would do. Yet, on the other hand, concerns about interference are legitimate. The TikTok algorithm is controlled by ByteDance, and that’s the one piece of the technology they do not want to hand over to someone else. With social media, the algorithm is the heart of the app, determining what we see in our feeds based on our preferences. The algorithm is where the real interference can happen. If a foreign entity wanted to influence Americans, they could tweak the algorithm to show specific content (for example, more posts from one specific candidate or one viewpoint). That is what has caused most of the stir in recent months and pushed this debate all the way to the Supreme Court. That said, President Trump has strong opinions. One report by CNN argues that Trump is a trailblazer on social media apps like TikTok; he has said that his campaign had “billions” of views prior to the election . Trump was once a TikTok naysayer when it comes to interference and tends to view everything through an America first lens. I suspect his change of heart is related to those billions of views which, in part, helped him get elected. I’m not sure Trump will be able to influence the outcome of the TikTok ban as much as he thinks he can. For starters, this is the Supreme Court—we’re not talking about elected officials or a federal agency he controls. I’ll be curious if the Supreme Court even responds to Trump about the TikTok ban. Usually, they tend to have their day in court, especially since it’s their court.Greg Gumbel did not care for parades. I’m not sure why. Maybe it was something about the artifice of it all, the way people got together and cheered for all those silly things that were strolling by. Mostly, I think, it was an affectation, a touchstone of humor for Greg to come off as curmudgeonly when everyone knew that he was actually the sweetest man alive. Greg also didn’t like golf. He tried it a couple of times, hated it, gave it up and then spent the rest of his life mocking the game and those who enjoyed it. This was a constant source of amusement because Clark Kellogg and I love golf almost as much as we love college basketball. When we would wax poetic on the CBS set about our respective games and the courses we’ve played, Greg would sit back in his chair and roll his eyes. He would make us chuckle with the overly grave tones he used when reading a promo for CBS’ golf coverage. If a highlight came on showing a player about to strike a putt, Greg would crack, “Bet it goes in.” Greg had a strong aversion to eggs and a Constanza-like ability to act hilariously annoyed at small things. But he loved a lot of things, too, like stand-up comedy and slapstick movies and Howard Stern. Once in a while during a highlight I would drop in a “Baba Booey” reference to see if I could throw him off on live TV. Greg and I were both fluent in Trading Places . There was literally no situation where some line from the movie couldn’t be dropped in and send us both guffawing. He had a very high batting average when it came to forwarding jokes over email. He loved classic rock, especially the Rolling Stones. He’d text me photos from all kinds of shows he was attending during the year. The only thing Greg loved more than laughing was making other people laugh. When you were around him, that’s what you usually did. Most of all, Greg loved his family, especially his granddaughter Riley. There was no conversation that he didn’t immediately steer her way. I can scroll through years of text messages with him and watch her morph from infant to young lady. Here’s Riley learning to walk, Riley snuggling a puppy, Riley playing the violin, Riley singing, Riley smiling with her grandpa. She was the center of his universe. Today is an immeasurably sad day , not just for me of course but for the countless people who knew and worked with Greg all these years. When people die, you always hear tributes about how great they were and how much everyone liked them. But I’m telling you, in all my years in this business, I have never heard anyone say one negative thing about Greg Gumbel. As far as I could tell, his only character flaw was his disdain for Bruce Springsteen, but I loved him for that, too. It’s what made Greg, Greg. You see, there are some people that we work with that we get really close to. They are wonderful relationships that are professional yet intimate. Then there are those precious few who are our closest friends. We know everything about each other, including the really uncomfortable secrets. It is rare to have someone who populates both lists, but Greg Gumbel was that for me. Same with Clark Kellogg. The three of us sat at that desk in Studio 43 for two decades and became brothers. I’d like to believe the viewers could tell. I know there are hundreds, perhaps thousands of people in the broadcast business who are saying the same thing today. You don’t understand, I didn’t just work with Greg Gumbel, we were really good friends. I’m not just talking about on-air folks, either. Greg was one of those truly special people who achieve great fame and success but never look at other people and see “levels.” When Greg walked into a studio, he was good to everyone. It’s not that he was humble, he saw no reason to be humble. He was just one of the gang and happy to be there, only please don’t bring him a plate of eggs. Even when Greg got cranky, he couldn’t stay that way. He was, to say the least, a masterful broadcaster. He could manage complicated traffic better than anyone I’ve ever seen. This was especially evident in the days when CBS had the rights to all of the NCAA Tournament games. We would constantly move audiences from one site to another, which could get especially gnarly as games were winding down. Greg had to preside over all that chaos while Clark and I watched in awe, never quite sure what was going on. In all the years we worked the tournament together, I only saw Greg mess up once. He had told the audience they were going somewhere, but the producer sent them somewhere else. He got frustrated and tossed his pen into the air. This was my first year working for CBS and the moment felt awkward. Uh oh, now Mr. Gumbel is really going to get angry. Just then, a cameramen named Claus, who was one of Greg’s best friends, told him, “Hey, if you’re tired, let somebody know.” The whole studio broke up, with Greg laughing harder than anyone. Because of all the switching between games in progress, it was inevitable that some viewers would get ticked off. CBS got lots of angry calls. Greg was frequently the focal point of their ire. I lost count of how many times he played the voicemail from the man who was screaming, “That Greg Gumbel, he’s terrible! He should be fired!” It was one of many inside jokes we referenced during every future tournament. The first appearance I did for CBS was during the 2003 Final Four. They had invited me on for a segment during their Sunday studio show to talk about the impending coaching carousel. I sat in the production meeting and went over what I planned to say. When it was time for rehearsal, I was nervous and hyper and delivered my info way too fast. Greg interrupted me. “No no no, just talk the way you talked during the meeting,” he said. “Just relax.” The words had the intended effect and the segment went smoothly. From that point forward, he always knew just what to say to me and when to say it. I started my first full season with the network that December. My oldest son was born the following May. Over the next five years I had two more boys. They used to come visit me in the studio. I have all kinds of photos of the three of them with Greg and Clark, steadily getting bigger with each passing year. The producers recorded video from the studio cameras during those visits, so I have that footage, too. Greg teasing them, Greg helping them into his chair, Greg being sweet to my wife while needling me. My boys are 20, 18 and 15 now. Greg watched them all grow up. Heck, he watched me grow up. Most of all, Greg was kind and considerate. We did 19 Selection Shows together and after every one he sent me a text message before he boarded his flight praising me for my work. He liked good company, off-color jokes, sharp suits, hot food and a tasty cocktail or two. When Greg, Clark and I got together for our annual dinner at the Final Four, it was always a treasured experience. We talked about everything and laughed so hard we’d have to dab our eyes. I’ll remember Greg as someone who kept my confidence up and my guard down. I wanted to be just like him, someone who took his work seriously but never himself. Greg made waves several years ago when he said during a radio interview that broadcasters were overpaid because no one turned on the games just to watch us. I’m sure I wasn’t the only one in the industry who gently suggested that next time he had such thoughts, he should kindly keep them to himself. And of course, there was the classic moment when Clark, Wally Szczerbiak and I danced on camera with the emojis during the 2021 NCAA Tournament . Greg refused to partake. We recorded the dancing and when the camera cut back to a live shot of Greg, he sat there silently with a stone cold expression on his face that said, “Can you believe how ridiculous those guys looked?” I used a screen shot of that face as my Twitter avatar for a while. Not that Greg understood what that meant. The last thing he would ever do was join social media, which struck him as one big noisy parade. When Greg got some tough medical news late last year, the only thing he knew for sure was that he wanted to keep it quiet. He didn’t want the attention, the fuss, the distraction of everyone knowing. “I have no illusions about this,” he told me as he started treatment. “We’re going to give it a shot. It will either work or it won’t.” For those who knew and loved him — and there are so many of us — his passing leaves a void too vast to contemplate. I hope my life will always be good, but it will never be quite as good without Greg in it. I’ve known for a while that this day was probably coming, but now that it’s here, I can hardly believe it. Greg leaves behind a legacy that is virtually unparalleled in the sports broadcast business. He worked in multiple places at the highest levels, calling Super Bowls and Final Fours and countless games in between. If you watched him on TV and thought, “He seems like a great guy,” I’m here to tell you that you were right. You can’t be in front of a camera for that many hours over that many years and hide who you really are. And even if you could, Greg would have never tried. That’s because he knew that life is short and laughter is vital. He figured that if you showed up, tried your best and treated people well, then nothing else mattered. He was a unique talent, a treasured friend and the kindest man I have ever known. May his memory be a blessing. The Financial Conduct Authority this year looked at whether some motorists who took out loans would be entitled to compensation. But a separate ruling by the Court of Appeal widened the scope of the scandal to take in more types of commission.
