New Zealand is getting a Biometrics Code. An announcement from the office of Privacy Commissioner Michael Webster states his intention to issue the Biometric Processing Privacy Code in 2025. The 124-page draft is now available for consultation. Members of the public and “any agencies it would apply to” are invited to submit input. Webster says the Code will help agencies implement , “while giving people confidence it’s being done safely and fairly.” It fills a gap in New Zealand’s regulatory landscape, which covers biometrics – but not, according to Webster, in enough specific detail. “New Zealand doesn’t currently have special rules for biometrics,” he says. “The regulates the use of personal information in New Zealand, including biometric information, but biometrics needs special protections especially in specific circumstances.” Amendments to address that need include requirements to do a proportionality test and implement privacy safeguards, stronger notification and transparency obligations, and “limits on some uses of biometric information (e.g. and types of biometric categorization).” They come after the Office of the Privacy Commissioner (OPC) consulted on an version earlier in the year, which garnered broad support but noted the need for certain changes, specifically around what processes are included and what organizations need to tell people. Webster says those changes are reflected in the latest version. A new requirement says that organizations must be clear in informing people where to find a public document listing “their assessment of the pros and cons of using biometrics.” And restrictions on , defined as fair use limits, are “now targeted to the most intrusive and highest risk uses.” In keeping with this, the Code has exceptions for individuals and “will generally not apply to consumer products.” The draft includes a comprehensive definition of biometrics and biometric processing. It covers rules around specific purposes and practices in collecting , to ensure that “generally, collection is for a lawful purpose, there are no alternatives with lower privacy risk, the collection is proportionate and appropriate privacy safeguards are in place.” (Per the draft, “you cannot collect information just in case you may want to use it later.”) The Code and its accompanying draft guidance material on compliance are open to feedback through March 2025. It is projected to come into force later in the year. Andrej Stojakovic made 11 free throws to help craft a team-high 20 points, freshman Jeremiah Wilkinson had his second consecutive big game off the bench and Cal ran its winning streak to three with an 83-77 nonconference victory over Sacramento State on Sunday afternoon in Berkeley, Calif. Wilkinson finished with 16 points and Rytis Petraitis 13 for the Golden Bears (5-1), whose only loss this season was at Vanderbilt. Public policy is ideally decided through reasoned discussions, not threats of violence. The spate of reported threats in recent days — first against some of President-elect Donald Trump’s Cabinet nominees and other appointees and then against Democratic lawmakers — takes the country further in the wrong direction. The nation’s investigative agencies should boost their efforts to track down threats to the point at which those considering making threats will have good reason to fear they will be caught. Everyone else should speak out against the corrosive effects of anonymous intimidation. On Thanksgiving, at least five Connecticut Democratic lawmakers said they were targeted with bomb threats while celebrating with their families at home. A day earlier, several of Trump’s Cabinet picks and administration appointees were similarly targeted with bomb threats or swatting, according to Trump’s transition team. Swatting is making a hoax 911 call to get a Special Weapons and Tactics (SWAT) team or other police units to show up in force at a victim’s home believing that a serious crime is taking place. Although no one was hurt, these incidents are not just an annoyance. In the past, police officers have been injured on their way to a scene. Innocent targets of swatting have had minor heart attacks. The costs of unnecessary mobilizations are a strain on the public purse. Swatting can also turn fatal if police misinterpret an innocent target’s response. It’s also possible responses to future legitimate emergencies could be slowed while responders ponder whether the threat they receive is legitimate. Being swatted can be a terrifying experience. Earlier this year, former U.S. Rep. Adam Kinzinger, R-Ill., described two 2011 swatting incidents at his Washington, D.C., apartment, which police later told him appeared to be a case of mistaken identity. “The shock and the potential danger posed to me and my neighbors in the building during the police operation was substantial,” Kinzinger wrote on CNN.com. Intimidation of lawmakers Moreover, the threats can shape lawmakers’ actions and votes. After the Jan. 6, 2021, attack on the U.S. Capitol, Rep. Jason Crow, D-Colo., said some House Republicans told him they wouldn’t vote to impeach Trump because they were frightened by threats they had received. That’s no way to run a government. How many other people have been muzzled by fear? Bomb threats and swatting are not necessarily simple crimes to solve. Using technology, perps can make it appear bogus calls to 911 are coming from those who turn out to be actual swatting victims. Such threats have been going on for some time. Maine Secretary of State Shenna Bellows was swatted Dec. 29 after issuing an opinion that Trump was ineligible to run in her state because of his role in the Jan. 6 insurrection. In March, a SWAT team forced Missouri Secretary of State Jay Ashcroft to come out of his home with his hands up. Among those targeted this year and last year were Georgia Lt. Gov. Burt Jones, Boston Mayor Michelle Wu and Ohio Attorney General Dave Yost, according to the Associated Press, and two judges handling cases involving Trump. And it’s not just lawmakers who are threatened. A bomb threat in Springfield, Ohio — following verbal attacks on Haitian immigrants in that city — sent parents scurrying in September to pick up their children from two elementary schools. Last year, some libraries in Illinois closed temporarily because of bomb threats made during heightened debate over which books should be on library shelves. People making anonymous threats of violence are like reckless motorists who dangerously weave at high speeds through lanes of traffic. If they think they can get away with it, they will keep doing it, perhaps leading to horrific crashes. Law enforcement should ensure people phoning in bomb threats or bogus 911 calls are caught as quickly as possible, and the courts should make certain perps pay a penalty commensurate with the damage done and enough to deter such behavior in the future. When I see senior executives buying lots of shares in the company they help run, I tend to take notice. The passive income stock I'm writing about today has seen one senior insider invest more than £1m over the last year. Roland HeadCOLUMBUS, Ohio – Ohio State coach Ryan Day attempted to offer an explanation for the post-game fight at Ohio Stadium. What happened? Michigan players tried to plant an "M" flag on the "Block O" after a stunning 13-10 victory against No. 2 Ohio State on Saturday. Several Buckeyes left the post-game tradition of singing "Carmen Ohio" to quite literally meet the Wolverines at midfield. Per the Ohio State Police, "multiple officers representing Ohio and Michigan used pepper spray." Following the game, officers from multiple law enforcement agencies assisted in breaking up an on-field altercation. During the scuffle, multiple officers representing Ohio and Michigan deployed pepper spray. OSUPD is the lead agency for games & will continue to investigate. "I don't know all the details of it, but I know these guys were looking to put a flag on our field and our guys were not going to let that happen," Day said. "We're embarrassed of the fact we lost, but there are some prideful guys on our team that weren't going to let that happen." The ugly scene marred the latest upset that will be etched into The Game rivalry lore, but it is a distraction from the main talking point. Michigan planted the same flag at Ohio Stadium two years after a 45-23 victory on Nov. 26, 2022, but that was a top-five team celebrating its first win in The Shoe since 2000. This was without question the Buckeyes' most embarrassing loss to the Wolverines over the last four years. The post-game fight is a distraction from the newly posed psychological test for Ohio State (10-2, 7-2), which lost the most important game of the season and now has to prepare for a run in the first 12-team College Football Playoff. What Ryan Day said after loss to Michigan Day – now 1-4 vs. Michigan – was left without an answer to what comes next after a loss in an all-in game against the Wolverines. Maybe that is because he simply does not have an answer for Michigan. "I don't know," Day said. "We're fresh off The Game. I don't really have the answer to that. We're very disappointed. Never thought this would happen right here." To be fair, few people did. The Buckeyes were three-score favorites. Michigan quarterback Davis Warren was 9 of 16 for 62 yards and two second-half interceptions to Ohio State standouts Caleb Downs and Jack Sawyer. That line alone would indicate a Buckeyes' win. Who had a 10-10 game at half? The Wolverines shutting out Ohio State in the second half? An upset that resembled the 14-9 shocker on Nov. 23, 1996 that was part of the lineage of John Cooper losses to inferior Michigan teams? And we're talking about planting a flag at midfield? What about the game plan? Ohio State continued to try to hammer at a Michigan run defense that featured future first-round picks Mason Graham and Kenneth Grant. Day seems hyper-obsessed with showing how tough the Buckeyes are in these big-game environments, especially against Notre Dame and Michigan. Ohio State had 26 carries for 77 yards. It was an imperfect balance with Will Howard – who was 19 of 33 for 175 yards, one TD and two costly interceptions. Jayden Fielding missed two field goals. "When we end up throwing 33 times out of 59 — more passes than runs — you can't just abandon the run.," Day said. "You have to be able to control the ball." "The turnovers, the rushing yards, you miss opportunities like those two field goals, yeah, it's going to cost you a game like this," he said. "Every yard matters. Every point matters." Michigan (7-5, 5-4) chipped away three-yards-at-a-time in 20-degree temperatures with Kalel Mulllings, who had 32 carries for 116 yards and a touchdown. He helped set up the game-winning field goal with a 27-yard run on third-and-6. Then, Mullings had some choice words for the Buckeyes afterward in a post-game interview with Fox's Jenny Taft. "At the end of the day they have to learn how to lose, man,” Mullings said. “We had 60 minutes, four quarters to do all that fighting. Now people want to talk and fight. That's bad for the game. Classless, in my opinion." This is an easy trap for Ohio State to fall into in order to find some explanation – any explanation – for the inability to take back control of a rivalry the Buckeyes have dominated for most of the 21st century. Ohio State is 17-7 against Michigan since 2000, but there was a fall-back each of the last three years. You cannot blame players having the flu, former Michigan assistant Connor Stalions stealing signs, a late interception by former Ohio State quarterback Kyle McCord or a post-game brawl. Michigan won the game. They planted a figurative flag at this point that the Buckeyes have not been able to tear down. In the end, Day will take the blame, and he accepted that afterward. "Everybody wants to win this game in the worst way, and nobody wants to win it more than we do," Day said. "It's our No. 1 goal every year. When you don't do that, that's disappointment and frustration." What's next for Ohio State? Now the challenge. Ohio State still is going to the College Football Playoff. The Big Ten championship is gone, but the chance to host a first-round home game is in the cards. The Buckeyes are good enough to win a national championship – but that will depend on the psyche of the team and the ability to block out the highly-toxic noise in Columbus about the failures against Michigan. This was supposed to be the year. The transfer portal spree that landed Howard, Quinshon Judkins and Caleb Downs. The hiring of UCLA coach Chip Kelly as the new offensive coordinator. A barely bowl-eligible Michigan team? This should not have happened. That game matters more than anything else, and we are about to find out just how much when Ohio State returns to the field. Texas went to the playoff without beating Oklahoma last year. But this is Ohio State-Michigan, and with all apologies to the Red River Rivalry, this one means a lot more. How else could you explain Howard and Cody Simon apologizing to the media afterward for the loss. Simon fought back tears. "I don't really know what it's going to look like, but this hurts," Simon said. "We have to come together as a team." Howard also fought back tears and it was short in his response. He had no comment about the post-game fight. He was one of the few who at least addressed what is next. He will start thinking about that Sunday. "We're a two-loss team, we're going to make the playoff and we're going to make a run, but this one hurts," Howard said. "It hurts." When asked a variation of the question and doubled down. "I just said we're going to regroup, go into the playoffs and make a run," Howard said. Start talking about that instead of planting a flag. The sooner the better.
