By Mead Gruver and Amy Beth Hanson, The Associated Press A judge on Monday rejected a request to block a San Jose State women’s volleyball team member from playing in a conference tournament on grounds that she is transgender. Monday’s ruling by U.S. Magistrate Judge S. Kato Crews in Denver will allow the player, who has played all season, to compete in the Mountain West Conference women’s championship opening this week in Las Vegas. The ruling comes in a lawsuit filed by nine current players against the Mountain West Conference challenging the league’s policies for allowing transgender players to participate. The players argued that letting her compete was a safety risk and unfair. While some media have reported those and other details, neither San Jose State nor the forfeiting teams have confirmed the school has a trans woman volleyball player. The Associated Press is withholding the player’s name because she has not commented publicly on her gender identity. School officials also have declined an interview request with the player. Crews' ruling referred to the athlete as an “alleged transgender” player and noted that no defendant disputed that the San Jose State roster includes a transgender woman player. San Jose State will “continue to support its student-athletes and reject discrimination in all forms,” the university said in a statement, confirming that all its student-athletes are eligible to participate under NCAA and conference rules. “We are gratified that the Court rejected an eleventh-hour attempt to change those rules. Our team looks forward to competing in the Mountain West volleyball tournament this week.” The conference did not immediately respond to an email seeking comment. The players filed a notice for emergency appeal with the 10th U.S. Circuit Court of Appeals. Crews said the players who filed the complaint could have sought relief much earlier, noting the individual universities had acknowledged that not playing their games against San Jose State this season would result in a loss in league standings. He also refused a request to re-seed the tournament without the forfeited losses. The judge said injunctions are meant to preserve the status quo. The conference policy regarding forfeiting for refusing to play against a team with a transgender player had been in effect since 2022 and the San Jose State player has been on the roster since 2022 -– making that the status quo. The player competed at the college level three previous seasons, including two for San Jose State, drawing little attention. This season’s awareness of her reported identity led to an uproar among some players, pundits, parents and politicians in a major election year. Crews' ruling also said injunctions are meant to prevent harm, but in this case, he argued, the harm has already occurred. The games have been forfeited, the tournament has been seeded, the teams have made travel plans and the participants have confirmed they’re playing. The tournament starts Wednesday and continues Friday and Saturday. Colorado State is seeded first and San Jose State, second. The teams split their regular-season matches and both get byes into Friday’s semifinals. The conference tournament winner gets an automatic bid to the NCAA tournament. San Jose State coach Todd Kress, whose team has not competed in the national tournament since 2001, has said his team has been getting “messages of hate” and that has taken a toll on his players. Several teams refused to play against San Jose State during the season, earning losses in the official conference standings. Boise State and Wyoming each had two forfeits while Utah State and Nevada both had one. Southern Utah, a member of the Western Athletic Conference, was first to cancel against San Jose State this year. Nevada’s players stated they “refuse to participate in any match that advances injustice against female athletes,” without elaborating. Nevada did not qualify for the conference tournament. The nine current players and others now suing the Mountain West Conference, the California State University Board of Trustees and others include San Jose State senior setter and co-captain Brooke Slusser. The teammate Slusser says is transgender hits the volleyball with more force than others on the team, raising fear during practices of suffering concussions from a head hit, the complaint says. The Independent Council on Women’s Sports is funding a separate lawsuit against the NCAA for allowing transgender women to compete in women’s sports. Both lawsuits claim the landmark 1972 federal antidiscrimination law known as Title IX prohibits transgender women in women’s sports. Title IX prohibits sexual discrimination in federally funded education; Slusser is a plaintiff in both lawsuits. Several circuit courts have used a U.S. Supreme Court ruling to conclude that discriminating against someone based on their transgender status or sexual orientation is sex-based discrimination, Crews wrote. That means case law does not prove the “likelihood of success” needed to grant an injunction. An NCAA policy that subjects transgender participation to the rules of sports governing bodies took effect this academic year. USA Volleyball says a trans woman must suppress testosterone for 12 months before competing. The NCAA has not flagged any issues with San Jose State. The Republican governors of Idaho, Nevada, Utah and Wyoming have made public statements in support of the team cancellations, citing fairness in women’s sports. President-elect Donald Trump likewise has spoken out against allowing transgender women to compete in women’s sports. Crews was a magistrate judge in Colorado’s U.S. District Court for more than five years before President Joe Biden appointed him as a federal judge in January. Gruver reported from Cheyenne, Wyoming, and Hanson from Helena, Montana. More in Nation-World News Iconic guitar maker trying to put a stop to Trump-themed offering Dow hits another record as stocks continue to rise This American corporation is cutting 2,000 employees five days before ChristmasWith trading volumes in futures and options (F&O) shrinking dramatically, a pressing question emerges: where did these volumes go? Some experts speculate the volumes might have shifted to small-cap stocks in the cash market. To protect investors and rein in speculative trading, India’s markets regulator took decisive measures targeting the derivatives segment (F&O), including reducing weekly option products that dominated trading volumes. This has led to a sharp decline in the total F&O turnover since November. The ripple effects are visible in the cash market as well. After peaking in July, the daily average turnover has been falling, particularly in large-cap and mid-cap segments. Adding to this narrative, a YES Securities report dated 17 December highlighted a sharp decline in the five-day average NSE total F&O turnover, from 413 trillion in January to 186 trillion in December. A trend emerging from this data is a likely shift of trading volumes from index derivatives to the small-cap cash market, said Hitesh Jain, lead analyst at YES Securities. “We sense that investors are increasingly focusing on small-cap opportunities, given the broader price resilience in these stocks compared to their large- and mid-cap counterparts over the last three months." While some market participants said this could be a valid hypothesis, others cautioned against drawing a clear link between trading volumes in the derivatives and small-cap markets. Over the past three months, the Nifty 50 has declined by 8.5% while the Nifty Smallcap 250 has dropped just 5%. The Nifty Midcap 100 has shed 6% in the same period. According to Chandan Taparia, head of derivatives wealth management at Motilal Oswal Financial Services Ltd, the decline in F&O volumes does not imply that these volumes have shifted to the small-cap cash market. “There is no correlation; it is merely a phenomenon," he said. He explained that while foreign institutional investors (FIIs) typically hold positions in index derivatives and heavyweights, domestic institutional investors (DIIs) tend to focus on small-cap and mid-cap companies due to their greater understanding of domestic businesses. With FIIs selling in recent months, F&O volumes decreased, leading to declines in some heavyweight stocks and gains in select mid-cap and small-cap stocks. FIIs, however, became net buyers in December after two consecutive months of selling in October and November, showed data from the National Securities Depository Ltd. In October, FIIs recorded net sales of 91,933.64 crore, followed by a more subdued selling spree of 18,258 crore in November. However, by 23 December, FIIs turned net buyers, with purchases totaling 20,906.33 crore. Meanwhile, DIIs have consistently been net buyers throughout 2024. They net purchased 105,253.33 crore in October, 44,483.86 crore in November, and 16,546.41 crore up to 23 in December. The investor profile varies significantly between F&O and cash markets, pointed out Kranthi Bathini, director of equity strategy at WealthMills Securities. While F&O trading primarily caters to those seeking quick gains, the cash market, particularly in the small-cap segment, focuses on value and sometimes momentum investing to achieve higher returns, he explained. The tools and strategies employed in derivative stocks differ entirely from those used in small-cap cash stocks, Bathini added, comparing the difference to that between George Soros and Warren Buffett. Buffett is renowned for his value investing approach, focusing on companies with rock-solid fundamentals. Soros, in contrast, is known for his speculative strategies, capitalizing on short-term market fluctuations and highly leveraged trades. Vinit Sambre, head of equities at DSP Mutual Fund, said small-cap and mid-cap stocks have become somewhat expensive and could underperform in the short term given the current uncertainty in the market. But when it comes to the long game, he believes both mid-cap and small-cap stocks are primed to build wealth. The Nifty Smallcap 250, with a current price-to-equity (PE) ratio of 30.89 times, sits slightly above its five-year average of 29.11. Yet, there is room for growth as the index’s decline this year isn’t as pronounced as the blue-chip index, according to market participants. On the other hand, the Nifty Midcap 100 is trading at a steeper PE of 39.85 times, surpassing its five-year average of 37.65.casino no deposit bonus

After lopsided loss, Patriots recognize an offseason roster overhaul is likelySen. Mitt Romney used his final, sometimes emotional speech on the floor of the Senate to call for bipartisanship to prevail over the nation's political divisions. "There are some today who would tear at our unity, who would replace love with hate, who would deride our foundation of virtue or who debase the values on which the blessings of heaven depend," the 2012 GOP presidential nominee said Wednesday, per . "I have learned that politics alone cannot measure up to the challenges we face," he added. "A country's character is a reflection not just of its elected officials, but also of its people. I leave Washington to return to be one among them." One regret is not solving the national debt, Romney said, pointing out that but for the expense of interest, the nation could afford to spend twice as much on Social Security benefits, for instance. He blamed "the scourge of partisan politics" for that failure, per the . He touted his work on the Bipartisan Infrastructure Law, the Electoral Count Reform Act, gun safety, and religious protections in marriage. "I will leave this chamber with a sense of achievement, but in truth, I will also leave with the recognition that I did not achieve everything I hoped," Romney said. The Utah Republican announced in September 2023 he wouldn't seek reelection, saying it was time for the next generation to take over but adding that he lacked faith in the leadership of President Biden and Donald Trump. Romney repeatedly has . Senate Minority Leader Mitch McConnell spoke before Romney did, saying Romney's "repeated success in public office is a testament to his transcendent appeal of his character." Romney was governor of Massachusetts before his election to the Senate, and McConnell said it might seem curious that he'd run for the Senate after that and his presidential run. "It wasn't about what he had left to prove," McConnell said, "but what he had left to give." (More stories.)

FC Twente will hope to pick up their first win of their Europa League campaign when they host Union SG in their fifth match in the competition on Thursday at De Grolsch Veste. The Dutch side are 27th in the Europa League table with three points and drew 2-2 with Nice on November 7, while their opponents drew 1-1 with Roma on the same date but are 30th in the table with two points. © Imago The hosts' game against Nice was a match of late drama given three goals were scored and both sides received one red card each in the final 30 minutes. However, the Eredivisie team will be bitterly disappointed by the draw considering they were leading 2-0 and played 20 minutes of the second half with a player advantage. Twente have drawn three of their four games in the tournament this season, with Lazio's 2-0 win on October 24 their only defeat. The Reds are currently fifth in the Dutch top flight and have 25 points from 13 outings, but boss Joseph Oosting may be disappointed by the fact his side are averaging slightly less than the 2.03 points per game they managed last term. Oosting's side are in good form having won two, drawn two and lost one of their last five games, though they have failed to achieve victory in any of their 12 most recent Europa League matches, drawing nine. The hosts have been difficult to beat at home considering they have been defeated just two times in their past 19 outings at De Grolsch Veste, but it should be noted that they have drawn five and lost one of their past nine home fixtures. © Imago As for the visitors, they are ninth in the Belgian top flight with 20 points from 15 games, though they are just two points from sixth-placed Gent, who occupy the final championship playoff spot. USG created just one big chance against Roma during their stalemate but they produced 14 shots compared to their opponents' 11 while also limiting the Italian side to just one big chance. Manager Sebastien Pocognoli will be concerned by his players' showing in the final third given they have scored one or fewer goals in eight of their last 10 games, failing to find the back of the net three times in that period. Pocognoli's side are unbeaten in their five most recent fixtures, but they have lost three, drawn three and won just one of their past seven Europa League games. USG have been poor away from home for some time, with the Belgian club triumphant in just one of their last 12 matches on the road, losing five and being held to a draw on six occasions. © Imago The hosts will be without right-back Bart van Rooij , who is suspended as a result of his red card against Nice, so expect Oosting to start a back four of Max Bruns , Gustaf Lagerbielke , Alec Van Hoorenbeeck and Anass Salah-Eddine . Winger Younes Taha is not scheduled to return from a broken leg until February next year and in his absence Daan Rots and Sayfallah Ltaief could flank striker Sam Lammers . Youri Regeer may start in an advanced midfield position behind Lammers, with Gijs Besselink and Mathias Kjolo protecting the defence in a double pivot. Union SG have a largely healthy squad, but will be unable to call upon wing-back Henok Teklab , who has been ruled out due to a broken leg. Kevin Mac Allister and Ousseynou Niang may be fielded either side of centre-backs Ross Sykes , Christian Burgess and Koki Machida . Elsewhere, wide players Alessio Castro-Montes , Guillaume Francois and Mamadou Traore are doubts, so perhaps Pocognoli will select a front two featuring Franjo Ivanovic and Mohammed Fuseini . FC Twente possible starting lineup: Tyton; Bruns, Lagerbielke, Van Hoorenbeeck, Salah-Eddine; Besselink, Kjolo; Rots, Regeer, Ltaief; Lammers Union SG possible starting lineup: Moris; Sykes, Burgess, Machida; Mac Allister, Khalaili, Vanhoutte, Sadiki, Niang; Ivanovic, Fuseini FC Twente have so far failed to impress in the Europa League, and they may struggle to hold onto a lead should they score first. While the visitors managed to earn a valuable point against Roma, they have been poor on the road this season and it would be surprising if they overcame their difficulties on Thursday. Donald Trump made an announcement about his upcoming administration, and his biggest fans are not happy about it. Trump said on Friday that he had chosen Dr. Janette Nesheiwat, a physician and Fox News medical contributor, as his surgeon general. She also "serves as a medical director at CityMD, a network of urgent care centers in New York and New Jersey," according to Politico's reporting . “Dr. Nesheiwat is a fierce advocate and strong communicator for preventive medicine and public health,” Trump said on Friday in a statement on his Truth Social platform . “She is committed to ensuring that Americans have access to affordable, quality healthcare, and believes in empowering individuals to take charge of their health to live longer, healthier lives.” ALSO READ: The America-attacking Trump is coming for our military — and then he's coming for us The pick did not go over well with Trump's base. @BlueArmy24, who frequently posts in favor of Trump on Truth Social, responded on the site with a letter from the "base." "Dear President Trump, many of us...MANY of us are very disheartened and upset about this pick -this doctor has been a major advocate for pushing Covid vaccines upon people which are being proven cause much harm," @BlueArmy24 wrote. "She also was a big advocate of masking and other terrible Covid policies please don’t let this happen! Sincerely -your base." A user with the ID "I STAND WITH TRUMP" also responded to the president-elect, saying, "Booo!! She advocates for the clot shot!!" "Bring the Surgeon General from Florida into this position!!" the user added. InkedKatLady , a self-identified conservative who comments favorably about Trump on Truth Social, characterized the pick as a "dealbreaker." "She’s pro-masking — dealbreaker for me," the user wrote in response to Trump's announcement for the choice for surgeon general. @SaltyPretzel, who shares pro-Trump content on Truth Social, also appeared outraged. "Are you out of your mind? We lost everything for refusing covid vax and you pic this pro vaxxer? What a slap in the face this is to maga," they wrote. Craig M. Wax, DO , a family physician who supports Robert F. Kennedy Jr., said Trump is "making a colossal mistake with Dr. Jeanette Neaheiwat has surgeon general." "She was a genetic vaccine zealot," he wrote Friday.
